Circular on Dispensation from the 30-day period and publication of banns

CIRCULAR No. 2/2009

RE: Dispensation from the Thirty-day Preparation Period and the Publication of Banns


Dear Reverend Monsignori and Fathers:

This is to reiterate some policies on Marriage promulgated by the Catholic Bishops’ Conference of the Philippines pursuant to canon 1067, and to specify archdiocesan policies in line with these.

The CBCP Complementary Norms of the Code of Canon Use, recognized by the Sacred Congregation of Bishops on September 27, 1985 (Prot. n. 35/84) under the heading of Nuptials and the sub-heading Pre-nuptial Inquiry provides the following:

On the preparation period:

#1 Those who intend to get married shall inform their proper parish priest, at least one month before the date of their wedding, in order to enable him to help them prepare for its celebration according to the laws of the Church. Only in very special cases and with the permission of the local ordinary can a wedding be solemnized within a shorter period of time. (italics supplied)

On Banns:

#17 Banns of marriage shall be announced orally or in print to the faithful for three (3) consecutive Sundays, or Holidays of Obligation, or on other days where there is a great convergence of the faithful. (italics supplied)

#18 The local ordinary may also allow the posting of the banns at the door or in the bulletin of the church, for a period during which there are three (3) Sundays or Holidays of Obligation, or other days where there is a great convergence of the faithful.

#19 The banns shall be announced in the proper parish of each of the contracting parties where they are better known according to the judgment of the priest who is conducting the investigation. (italics supplied)

#20 Publication of the banns shall also be done in other parish or parishes where there exists a reasonable suspicion that either or both parties might have incurred a matrimonial diriment impediment.

#21 The parish priests of the aforesaid parties are earnestly requested to cooperate with the parish priest who conducts the pre-nuptial interview by carrying out, at the latter’s request, the publications of the banns and by sending him the results in due time.

#22 When the parishes where the interview or the publication of the banns are to be done belong to different dioceses, the request to perform them as well as the transmission of the information already obtained shall be coursed through the diocesan curia of the parish where the banns are to be published.

#23 There shall always be a period of at least two (2) days between the last publication of the banns and the celebration of marriage. (italics supplied)

Considering the spirit of the CBCP Norms, as well as to avoid abuses and confusion, we decree the following policies to reiterate, to clarify and to add to the abovementioned:

A. On the preparation period:

1. It is to be conscientiously observed, that those who intend to get married shall inform their proper parish priest, at least one (1) month before the date of their wedding, in order to enable him to help them prepare for its celebration according to the laws of the Church. (also reiterated by September 29, 1992 Circular of Archbishop Quevedo)

2. To emphasize the importance of preparation for marriage, although they may be granted, exceptions are to be discouraged. Only in very special cases and with the permission of the local ordinary can a wedding be solemnized within a shorter period of time.

3. Dispensation from the thirty-day (30-day) prescription may be granted by the local ordinary (the Diocesan Bishop, the Vicar General, or the Episcopal Vicar). Ordinarily, the Episcopal Vicar may grant the dispensation.

4. Those who seek dispensation shall ask the parish priest to request from the local ordinary on their behalf. The letter of request shall be given to the local ordinary. The local ordinary then grants a rescript.

5. Dispensation fee shall be Php 500 for the Vicarial Fund, plus Php 50 per diem, which shall be for the parish where the marriage will be solemnized.

6. The Episcopal Vicar is to record the dispensation in a Book of Dispensations.

B. On banns:

It is to be conscientiously observed that three (3) banns of marriage shall be announced orally or in print to the faithful for three (3) consecutive Sundays, or Holidays of Obligation, or on other days where there is a great convergence of the faithful to guarantee the absence of impediments.

Only in very special cases and with the permission of the Diocesan Bishop, or a local ordinary with his express delegation may the number of banns be reduced.

The parish priest, having ascertained the eligibility of the parties to marry is to request from the Diocesan Bishop or to whom he expressly delegated the faculty a dispensation from the banns. The letter of request shall be given to the Diocesan Bishop or to whom he expressly delegated the faculty, who responds through a rescript. Ordinarily, the Episcopal Vicar may grant the dispensation.

Dispensation fee shall be Php 500 per unannounced banns. The fee shall be added to the Vicarial Fund.

The dispensation is to be promptly recorded in a Book of Dispensations.


Anything to the contrary is abrogated. This is for immediate implementation in the Archdiocese. I enjoin that there be thorough catechesis as a result of these policies.
